投标须知
Instructions to Bidders
1、凡具有法人资格，有生产能力或供应能力，能满足需方技术要求及信誉良好的供应商，均可参加投标。
1. All suppliers who have legal
personality, production or supply capacity, and sound reputation, and meet
the technical requirements of the Employer, can submit a bid.
2、投标方应遵守国家的有关法律、法令和条例。
2. All bidders shall abide by the relevant
laws, decrees and regulations of China.
3、投标企业注册资金不能少于500万元人民币
，特殊情况须单独说明。
3. All bidders shall have a registered
capital of not less than RMB 5 million Yuan, and if there is any special
circumstance, specify separately.
4、投标委托：如投标方代表不是法人代表，须持有《法人代表授权委托书》
4. Authorization of bidding: in case the
bidder’s representative is not a legal representative, he/she shall hold a
Power of Attorney of the Legal Representative.
5、投标方是否中标均自行承担所有与参加投标有关的费用。
5. The bidder shall bear any and all
expenses incurred in connection with its participation in the bid, no matter
whether it is awarded the contract.
6、投标保证金：（如不能满足以下关于投标保证金的要求，取消投标资格）
6. Bid security: (If a bidder
doesn’t satisfy the following requirements for the bid security, it will be
disqualified for bidding.)
（1）投标方应提供不少于招标金额3%的投标保证金。
(1) The bidder shall provide a bid
security of not less than 3% of the tender amount.
（2）为了方便投标保证金的及时退还，投标保证金应在开标前必须以电汇方式提前两天交招标方，招标前将电汇底单复印件及标书费一并上交招标单位工作人员。（不收取银行承兑、汇票、转账支票，不得以货款作为保证金。）
(2) In order to facilitate the timely
refund of the bid security, the bid security shall be wired to the
tenderee within two days prior to the bid opening, and the copy of
the stub of wire transfer and payment of the tender document shall be
submitted and made to the tenderee’s relevant staff. (No bank acceptance
bill, draft or transfer check will be collected, and no payment for goods
may be taken as the bid security.)
要求保证金的电汇底单上必须清楚的注明投标单位的开户行（具体到支行）、银行账号、抬头等信息，以方便我司及时准确的退还保证金。
The stub of wire transfer of the bid
security must be clearly stated the bidder’s bank (specific to the
sub-branch), bank account No., and account name, so as to facilitate our
timely and accurate refunding of the bid security.
（3）中标方的保证金，在与买方签定合同后留作履约保证金，货到后无息退还。
(3) The bid security of the winning bidder
shall be retained as the performance bond after it signs the contract with
the buyer, and then refunded without interest after the goods are delivered.
（4）落标方的保证金，在落标后按照电汇底单复印件的银行信息以电汇方式无息退还。
(4) The bid security of the losing
bidders shall be refunded without interest via wire transfer according to
the bank information indicated on the copy of the stub of wire transfer.
（5）在投标有效期内，投标方撤回标书和不按中标通知的时间、地点签定合同的，保证金将被没收。
(5) Within the validity of the bid, where the
bidder withdraws its bidding document or fails to sign the contract at the
time and in the place stipulated in the letter of acceptance, the bid
security of the bidder will be forfeited.

10、招标文件的澄清：
10. Clarification of tender document:
投标方对招标文件如有疑点要求澄清，或认为有必要与用户进行交流时，要用书面、传真、电报形式通知招标方，招标方用同样形式做出回答。
Where the bidder requests clarification for any question
about the tender document or considers it necessary to communicate with the
users, it shall notify the tenderee in writing, or by fax or telex, and the
tenderee shall answer in the same form.
11、招标文件的修改：
11. Amendment of tender
document:
（1）在投标截止时间前，招标方无论出于自己的考虑，还是对投标方提出的澄清，均可对招标文件用补充文件的方式进行修改。
(1) Before the deadline for bidding, the
tenderee can amend the tender document in the way of supplementary
documents, either for the cause of its own consideration or for the
clarification of what the bidders put forward.
（2）对招标文件修改，将以书面、传真、电报形式通知已收到招标文件的投标方，补充文件将作为招标文件的组成部分，对所有投标方都具有约束力。
(2) Any amendment made to the tender document
shall be made notified to the bidders receiving the tender document in
writing or by fax or telex, and the supplementary document(s) shall be an
integral part of the tender document and binding on all bidders.
